These Terms and Conditions (“Terms”) govern your use of the My Canadian Stock website and any purchase you make through it. By using this site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the site or place an order.
My Canadian Stock sells liquidation pallets, truckloads, overstock lots, and Volume Discount lots to buyers across Canada, operating from locations in Montréal, Québec and the Toronto (Markham), Ontario area. See our Locations page for details.
You must be at least 18 years old and able to form a legally binding contract to place an order with us.
All products listed on this site, including pallets, truckloads, overstock lots, and Volume Discount lots, are liquidation, customer return, or overstock inventory. Products are sold as is and as available, with no warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or that items are new, complete, undamaged, or in working condition. Items may be missing parts, packaging, or accessories, and may show signs of prior use, testing, or damage.
Some lots are manifested (they include an itemized list of contents) and some are not. Where no manifest is provided, we do not represent the exact contents, unit count, or retail value of that lot; any figures shown are approximate.
Where a manifest is provided, it is supplied to us by the source retailer or liquidator and is provided for informational purposes only, not independently verified item by item. As is standard in the liquidation industry, a manifest may occasionally contain a small percentage of errors, including items that are missing, incorrect, or damaged. We do not guarantee that a manifest is complete, accurate, or free of errors, and actual contents, condition, or quantities may vary from what is listed.
All prices are listed in Canadian dollars (CAD) unless stated otherwise and are subject to change without notice. Availability is not guaranteed until an order is placed and confirmed. We reserve the right to limit quantities, or to refuse or cancel any order at our discretion, including in cases of pricing errors or suspected fraud. If we discover an error in a price, description, or listing after you have placed an order, we may correct it and cancel or adjust the affected order; if we cancel your order for this reason before it has shipped or been picked up, you will receive a full refund for that order.
Orders can be placed through our online checkout, which is processed by our checkout provider. By placing an order online, you authorize us and our payment processor to charge your chosen payment method for the total order amount, including applicable taxes. We also accept eTransfer and cash; contact us using the information on our Contact page to arrange either of these payment methods.
Because our inventory consists of liquidation, customer return, and overstock goods sold as is, all sales are final. We do not accept returns or offer refunds or exchanges, except where required by applicable law, for example if a product received is materially different from what was described at the time of sale. To raise an issue with an order, contact us at contact@mycanadianstock.ca within 48 hours of delivery or pickup.
If you create a customer account, you are responsible for maintaining the confidentiality of your login and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You agree to provide current, complete, and accurate information for your account and any order, and to promptly update it as needed so we can fulfill your order and contact you.
We reserve the right to refuse service to anyone, and to limit, cancel, or refuse any order, at our sole discretion and for any reason, including suspected fraud or abuse, or a violation of these Terms.
You agree not to use this site for any unlawful purpose, to attempt to gain unauthorized access to our systems, to resell products in a manner that violates applicable law, to submit false or misleading information, to interfere with or circumvent the security of the site, or to interfere with the proper functioning of the site.
This site relies on third party services to operate, including Shopify (checkout, payments, and customer accounts), Google Maps (location information), Google reCAPTCHA (spam protection), and a live chat provider. These services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third party service or any external website linked from this site.
To the maximum extent permitted by law, My Canadian Stock and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or purchase of any product, including lost profits, even if advised of the possibility of such damages. Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product giving rise to the claim.
You agree to indemnify and hold harmless My Canadian Stock and its owners, employees, and affiliates from any claim, loss, or demand, including reasonable legal fees, made by any third party arising from your breach of these Terms or your violation of any law or the rights of a third party.
All content on this site, including text, graphics, logos, and images, is the property of My Canadian Stock or its licensors and may not be copied, reproduced, or used without our prior written permission.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
These Terms, together with any policies referenced in them (including our Privacy Policy), make up the entire agreement between you and My Canadian Stock regarding your use of the site, and supersede any prior agreements or understandings. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
We may update these Terms from time to time. Changes take effect once posted to this page. Continuing to use the site after changes are posted means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable within it.
